Is January the most common month for Sauk County divorce?

No, but divorce filings are slightly elevated in January than some other months.  Much as in Dane County, Sauk County divorce filing was most common in July.   Sauk County Divorce filings averaged between 18 and 26 in most months, on the high end in January.  However, in July and August, the number rose by about 40%, to 34 filings per month.  January is often considered “divorce month” as this article demonstrates  http://www.huffingtonpost.com/2011/01/04/january-more-divorces-tha_n_803958.html, but that may not necessarily be true.

Perhaps one of the reasons for the higher rate of filings in Dane and Sauk during those months the summer school break.  Parents may wish to allow their children a few months to get used to new living and family arrangements before the school year begins.  Parents may also have more to devote to legal matters, finding a new residence, etc. when the children are home for the summer.  Whatever the reason, it is not likely a coincidence that the frequency of Dane County and Sauk County divorce filings follows a similar pattern.

The timing of a divorce filing may be important for legal, financial, or child custody purposes.  Of course, filing for separation may be driven by necessity, for example, in cases of domestic violence or wasting of assets by one spouse.  I often work with spouses considering a Sauk County divorce to establish an action plan.  The plan includes safety concerns (if necessary), arrangements for a temporary residence, ensuring access to funds, and discussion of how and when to inform the children and other spouse.   In cases that require immediate action in the form of a temporary order, the Sauk County divorce court can often schedule a hearing sooner than the Dane County court.  The procedures and timing to requetst a hearing are also slightly different (perhaps easier) in Sauk County.
